Pool Safety Certificate Registration 2016

In a strata or community scheme, all of the lot owners jointly own any swimming pool or spa pool that is on common property.

The owners corporation is responsible for ensuring such pools are compliant with the Swimming Pools Act 1992.

The law applies to any excavation, structure or vessel including swimming pools and spa pools that are:

  • capable of being filled with water to a depth greater than 30cm, and
  • used, designed, manufactured or adapted for swimming, wading, paddling or any other human aquatic activity.

NSW legislation that came into effect on 29th October 2013, requires that pools are inspected, certified and registered on the NSW Pool Registry to ensure it meets the requirements of the Australian Standards and pool safety legislation.

If you are selling or leasing your property that has a swimming pool, then you’ll need your pool certified by an accredited certifier.

A valid swimming pool certificate of compliance must be attached to the contract for the sale of properties with a swimming pool or spa pool. Failure to attach the certificate means that the purchaser may be entitled to rescind the contract at any time within fourteen days of exchange unless settlement has already occurred.

Call Strata Plus to obtain a certificate of compliance for your swimming pool.
